Geeks On Repair Technician Agreement

Please read this agreement carefully. When you check the box at the bottom and continue, you are entering a binding contract between you ("Technician," "you") and Geeks On Repair ("Geeks On Repair," "we," "us").
1. About this database
This technician database is for Geeks On Repair's internal use. It is how we find qualified independent technicians when a customer needs help in your area.
What the public can see. Your public listing shows only:
- your first name and the first two or three letters of your last name,
- the service areas you select, and
- the skills you list.
What stays private. We never show your phone number, email address, street address, driver's license, or payment details publicly. Only authorized Geeks On Repair staff can see them.
2. Your electronic signatures
This agreement is signed electronically, twice:
1. Checkbox signature. When you check the agreement box, we record your IP address, the date and time, and the version of this agreement. Together these serve as your electronic signature.
2. Email confirmation. After you sign up, we email you a verification link. Clicking it is your second signature to this same agreement and confirms that the email address is yours.
You agree that these electronic signatures are as binding as a handwritten signature.
3. Becoming a Geeks On Repair technician
To be offered jobs, you must:
- A. Agree to these terms by checking the box below.
- B. Complete your technician profile on the next page, including your contact details, home base ZIP code, the service areas you cover, and your skills.
- C. Upload a clear photo or scan of your valid, unexpired, state-issued driver's license. You may upload it after your first assignment, but it must be on file before your second. We require it because we must know exactly who we are sending into our customers' homes and businesses. Your license is stored privately and is never shown publicly.
- D. Verify your email address using the link we send you.
4. How jobs are offered
When a customer needs work in a service area you selected, we will contact you by phone call, text message, and/or email, using the contact details in your profile. We will tell you about the job and ask whether you are willing and able to do it.
You are always free to accept or decline any job. We do keep track of which technicians accept and successfully complete the most jobs, and those technicians are contacted first when new jobs come up.
5. Working with our customers
While you are on a Geeks On Repair job:
- You represent Geeks On Repair. Treat every customer with the same care and respect you would want for your own family.
- Communicate with the customer only as the job requires. Any other direct contact needs prior approval from a Geeks On Repair supervisor.
- Do not promote, mention, or hand out information about your own business, services, website, or contact details.
- Check in and check out. Call or text us when you arrive, and call us again when the work is done. Before you leave, you must put the customer on the phone with us so we can confirm the work with them.
6. Customer protection: non-solicitation and non-poaching
This section applies equally to every technician registered in this database.
Geeks On Repair customers belong to Geeks On Repair. Any customer you serve, meet, or have contact with through a Geeks On Repair job or this platform (a "Geeks On Repair Customer") remains our customer, not yours or your company's.
During your relationship with Geeks On Repair and for 12 months after it ends, you agree that you will not, directly or indirectly, yourself or through any other person or business:
1. solicit, contact, or accept work from any Geeks On Repair Customer, except through Geeks On Repair;
2. encourage or invite a Geeks On Repair Customer to call, text, email, or book you or your company directly, now or in the future;
3. give a Geeks On Repair Customer your personal or business phone number, email, website, social media, business card, or other contact information;
4. offer a Geeks On Repair Customer a lower price, discount, or "side deal" to work with you directly; or
5. use any customer name, address, phone number, or other customer information obtained through Geeks On Repair for any purpose other than the assigned job.
If a Geeks On Repair Customer contacts you directly, you agree to refer them back to Geeks On Repair and let us know.
This is not a non-compete. We know many of our technicians run their own businesses, and you are free to do so. We see you as a teammate, not a competitor. This section covers only the customers you actually serve, meet, or have contact with through us. It does not cover anyone you already worked with before, or anyone you find on your own.
What happens if a technician takes a customer
We want technicians who value their independence, and we respect it. This section is simply the fair price of access to our customers. If you solicit or take a Geeks On Repair Customer in breach of this section, these consequences apply:
- Immediate removal. Your technician status ends right away, your profile is deactivated, and you will not be offered further jobs.
- Pending payments. Any payment for work performed in breach of this section is forfeited. Geeks On Repair may also hold any other pending payments owed to you and apply them toward the amounts you owe under this section.
- Lost customer value. You will owe Geeks On Repair the full amount it would have earned from that customer's work that you performed or diverted, from the first breach through the end of the 12-month period after your relationship ends.
- Legal costs. If Geeks On Repair has to enforce this section, you will also be responsible for its reasonable attorney's fees and court costs.
- Court order. Geeks On Repair may ask a court for an order (an injunction) to stop the breach.
These consequences apply only to breaches of this section. Declining jobs, working for your own customers, or running your own business never triggers them.
If a court finds any part of this section too broad, it should be enforced to the fullest extent the law allows, and the rest of this agreement remains in effect.
7. Call recording and AI transcription
You agree that phone calls between you and Geeks On Repair, including job offers, check-ins, check-outs, and calls where a customer is on the line, may be recorded and may be transcribed or summarized by artificial intelligence (AI) tools. We use recordings and transcripts to dispatch jobs, confirm completed work, resolve disputes, keep accurate records, and improve our service.
By accepting this agreement, you give your consent to this recording and transcription for all such calls. Geeks On Repair will also tell everyone on a recorded call that it is being recorded, including any customer on the line, and will ask for their consent. Because Geeks On Repair does this on every call, the process works in every state, including states that require every person on the call to consent.
8. Pay
Hourly rate. You are paid for the time between your check-in call or text on arrival and your check-out call when the work is done, before you leave.
- One-hour minimum. Every on-site visit is paid at least one hour, even if it takes less time.
- After the first hour, time is paid in 15-minute increments at the same hourly rate.
Flat-rate jobs. Occasionally, for certain jobs that meet our criteria, we may offer a flat fee instead of hourly pay. The fee is always agreed with you before you go to the job.
Travel bonus. For jobs more than 50 miles one way from the home base ZIP code in your profile, you and Geeks On Repair may agree on a travel bonus before the job.
When and how you are paid. Unless customer-direct payment has been approved for a job (see below), you are paid directly by Geeks On Repair through PayPal, Cash App, or Upwork (your choice, saved in your profile). Payment is sent as soon as the job is completed, within one hour after you have put us on the phone with the customer and before you leave the location.
Customer-direct payment (optional). After you have completed two jobs with Geeks On Repair, you may ask to be paid directly by the customer. Geeks On Repair decides whether to allow this, one job at a time, and may stop allowing it at any time. The customer still belongs to Geeks On Repair, all of Section 6 still applies, and you must still check in, check out, and put the customer on the phone with us before you leave.
9. Taxes and 1099 forms
You are an independent contractor, not an employee, and you are responsible for your own taxes.
- Payments through Geeks On Repair directly (PayPal or Cash App). Geeks On Repair will issue any tax forms required by law, such as IRS Form 1099-NEC, for payments it makes to you. PayPal and Cash App may also issue their own tax forms under their own rules.
- Payments through Upwork. Upwork handles tax reporting for payments made on its platform, so you do not need to request a 1099 from us for those payments. You may switch to being paid through Upwork at any time. To do so, you will need an Upwork profile, and once you switch we will pay you only through Upwork for the rest of that calendar year.
- Please keep your own records of payments received from us.
10. Independent contractor relationship
Nothing in this agreement makes you an employee, partner, or agent of Geeks On Repair. You choose which jobs to accept, you provide your own tools and transportation, and you control how you perform the work, as long as you meet our customer-service standards and the terms above.
11. State addendum and governing law
One agreement everywhere, plus your state's addendum. Sections 1 through 10 are the same for every technician in every state. Some states have their own rules on call recording, customer non-solicitation, or independent contractor status. For those states, a short State Addendum applies. You will see only the addendum for your state, which is the state of the home base ZIP code in your profile. If you take a job in another state, any stricter protection required by that state's law for that job also applies.
State law comes first. If any part of this agreement conflicts with a law that applies to you, the law wins, and that part is applied only as far as the law allows. The rest of the agreement stays in effect.
Governing law. Apart from your State Addendum, this agreement is governed by the laws of the Commonwealth of [Virginia], except where your state's law requires otherwise.
12. Your agreement
By checking the box below and continuing to the next page, you confirm that you have read, understood, and agree to follow all of the terms above, including the customer non-solicitation terms in Section 6, the call recording and AI transcription terms in Section 7, and the State Addendum for your state, if one applies. You also agree that this is a binding contract between you and Geeks On Repair.
